STATUTORY QDRO REQUIREMENTS:

1 Does it include the legal name of the plan to which the order applies?
2 Is it a domestic relations order relating to child support, alimony or marital property being awarded to a dependent of a participant?
3 Does it include the participant’s name?
4 Does it include the participant’s last known address?
5 Does it include the alternate payee’s name?
6 Does it include the alternate payee’s last known address?
7 Does it create and/or recognize an alternate payee?
8 Does it include a definitely determinable benefit in an amount or percentage (or a clear method for determining the awarded benefit)?
9 Does it comply with the terms of the plan (example: does it limit the award to 100% of the participant’s benefit and provide instructions for payment of benefits)?
10 Does it refrain from increasing benefits to the alternate payee?
11 Does it limit its award to ensure that previously entered QDROs are not affected?
